Terms of Use

Last updated: October 31, 2026

The short version: Eyewit is a tool that can help in an emergency. It is not a guarantee of safety, and it does not replace 911, the police, a lawyer, or a doctor. Use it only for real emergencies, and use it at your own risk.

1. Agreeing to these terms

By using Eyewit, or by tapping "I understand" in the app, you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use Eyewit.

2. What Eyewit does

Eyewit is a personal safety app. It can record video on your phone, open a text message to your family with your location, sound an alarm, show your health information on screen, guide you with steps, and make a log of what happened.

3. What Eyewit does not do

4. Real emergencies only

Do not use Eyewit to make false alarms, false reports, or prank alerts. Misusing it can be a crime. In California, for example, false emergency reports and misuse of 911 can lead to arrest, fines, or jail. You are responsible for every alert you start.

5. Recording laws are your responsibility

Laws about recording people differ by state. Some states, including California, require everyone's consent before recording a private conversation. Recording police officers doing their jobs in public is generally allowed in the United States, but you must not interfere with them. It is up to you to follow the law where you are.

6. Your responsibilities

7. Eyewit Pro and AI Witness

Some features, like AI Witness, may be part of a paid Pro plan. AI Witness answers can be wrong. Always use your own judgment, and call 911 when someone may be in danger.

8. No guarantee

Eyewit is provided "as is" and "as available." We do not promise that it will always work, be error-free, or keep you safe. To the fullest extent the law allows, we are not responsible for any harm, loss, or damage that comes from using or not being able to use Eyewit.

9. Limit of liability

To the fullest extent the law allows, our total responsibility to you for any claim about Eyewit is limited to the amount you paid us for Eyewit in the 12 months before the claim, or $10 if you paid nothing.

10. Age

You must be 18 or older to use Eyewit, or have permission from a parent or guardian who agrees to these terms for you.

11. Changes

We may update Eyewit and these terms. When we make a big change, we will update the date at the top. If you keep using Eyewit after a change, you accept the new terms.

12. Law that applies

These terms are governed by the laws of the State of California, United States.
